QpHomes : Subscription Terms

When you purchase a property listing package from QpHomes you agree to all of these Subscription Terms.

Please read the following subscription terms carefully, as they form an agreement between us.

Introduction
QpHomes is an online property listings service (the "Service") provided by Vivid Medianet Limited of 77 Beak St, W1F 9DB, UK and its suppliers ("we"/"our"/"us").

Purchase Agreement
These Subscription Terms form our entire agreement for the purchase of property listing packages and supersede any prior agreement or arrangement with you regarding such purchase. To purchase a property listing package you should select one of the property listing packages that are offered to you in an email or on the site when you wish to advertise your property. When you click on the link for the property listing package that you would like to purchase you will be taken to the QpHomes Secure Payment Page. Please review your order, and if necessary click on your internet browser "back" button in order to make any necessary corrections to your order or one of the navigational links to abandon the purchase. When you are satisfied with the details of your order, please enter the card details you would like to use to purchase your property listing package. Up until you click on the Go >> button on this page (which will send your order and payment to us) you will be able to use the "back" button on your internet browser to correct and change any details of your order.

All orders for property listing packages made by you shall be deemed to be an offer by you to purchase such property listing packages according to these Subscription Terms. Nothing contained on QpHomes or in these Subscription Terms shall be an offer that is capable of being accepted by you or by any other person, or of being binding on us. Acceptance by us of an offer by you shall take effect on the notifiction by us that your payment transaction has been processed successfully. If you purchase a recurring property listing package (currently either a weekly, monthly, quarterly or annual package), then you will also receive an email from us confirming the details of your future payments agreement with us.

Price and payment
The price shall be the price quoted on your accepted order. Where the supply of services is subject to UK VAT, the price is inclusive of UK VAT at 17.5%, VAT number [792 3342 20]. If you purchase a recurring property listing package (currently either a weekly, monthly, quarterly or annual package), then you will pay the price quoted on your accepted order in advance every week, month, three months or year as appropriate. You may cancel any recurring property listing package by following the instructions set out in section 5 below.

Use of the Service
The use of the Service is subject at all times to our Terms and Conditions.

Cancellation
You do not have the right to reject the property listing package once you have paid for it. However, if for any reason you are unhappy with the property listing package received, please send feedback using the facilities on the site and we will endeavour to resolve your complaint.

If you purchase a recurring property listing package (currently either a weekly, monthly, quarterly or annual package), then you may cancel the property listing package at any time by logging onto the QpHomes site at http://qphomes.adriantear.com, entering in your login details and clicking on the My Property and then the View Subscription links. Alternatively you can send feedback using the site asking us to cancel the agreement and we will process this for you within two working days of our receipt of your cancellation request. Either way such cancellation will take effect at the end of the current week, month, quarter or year respectively for which you have paid for in advance.

Intellectual property
The materials and information on the Service and the structure, overall style and program code of the Service are protected by copyright. QPHOMES and the QpHomes logo are trade marks of Vivid Medianet Limited. You must not use these or any other registered or unregistered trade marks on the Service without our prior written permission. The provisions of this section 7 do not apply to material placed on the Service by users.

Your liability
If you use the Service for any illegal purpose or for any purpose other than that expressly permitted by these Subscription Terms or by our Terms and Conditions, or otherwise in breach of these Subscription Terms, you will indemnify us in full for any loss, liability or cost which we incur arising from or in connection with such use or alleged use.

Our liability
We shall not be liable to you or in breach of these Subscription Terms for any delay or failure to perform any obligation if the delay or failure is due to a cause beyond our reasonable control including, without limitation, the blocking or restricting of information to and/or from our computer network. Except as expressly provided in these Subscription Terms, we expressly disclaim any further representations, warranties, conditions or other terms, express or implied, by statute, collaterally or otherwise, including but not limited to implied warranties, conditions or other terms of satisfactory quality, fitness for a particular purpose or reasonable care and skill. We shall not be liable in contract, tort (including negligence), statutory duty or collaterally or otherwise arising out of or in connection with these Subscription Terms for consequential, indirect or special loss or damage or any economic losses (including loss of revenues, profits, contracts, business or anticipated savings), in each case, even if we have been advised of the possibility of such loss or damage and howsoever incurred. Our maximum liability to you in contract, tort (including negligence), statutory duty or collaterally or otherwise arising out of or in connection with these Subscription Terms shall be limited in respect of any twelve month period to the sums paid by you to us in such period under these Subscription Terms or �50, whichever is the greater. Notwithstanding any other provision of these Subscription Terms, we will be liable to you without limit for any death or personal injury caused by our negligence and to the extent that liability arises under Part 1 or section 41 of the Consumer Protection Act 1987 and for liability arising from statements made fraudulently by us.

General
Nothing in these Subscription Terms shall confer on any third party any benefit or the right to enforce any term of these Subscription Terms. Nothing in these Subscription Terms affects your statutory rights as a consumer.

Applicable law
This Agreement is governed by English law and any dispute connected with this agreement is subject to the exclusive jurisdiction of the English courts.
